Terms and conditions

Le presenti Condizioni Generali di Vendita hanno per oggetto l’acquisto di prodotti su Team’s Delivery effettuati a distanza tramite rete telematica sul sito www.teamsdeliverysrl.it, di ALEMACO Srl, Lungoporto Antonio Gramsci 19 – 00053 – Civitavecchia (RM) Italia. Ogni operazione d’acquisto sarà regolata dalle disposizioni di cui al DLgs. 185/99, DLgs. 206/05; le informazioni dirette alla conclusione del contratto saranno sottoposte all’art. 12 del DLgs. 70/03 e, per quanto concerne la tutela della riservatezza, sarà sottoposta alla normativa di cui al DLgs. 196/03.

2. SALE PRICES, PURCHASING METHODS, INVOICING
2.1 The sale prices displayed on the website www.teamsdeliverysrl.it are intended as an offer to the public by Fineservice , inclusive of VAT and any other taxes. The prices displayed do NOT include shipping costs. The Customer will take care to view the amount of shipping costs, before proceeding with the purchase. The purchase contract is finalized only through the correct completion of the order form published on the site and through the consent to the purchase, manifested through the online membership. The Customer may choose the method of payment prior to the confirmation of the order, using the methods indicated ON LINE.
2.2 The payment of the goods by the Customer will be made using the method chosen when placing the order. Nothing more is due from the Customer than the total amount of the order.
2.3 Any sales invoice must necessarily be requested when the purchase order is placed. It will not be possible to issue an invoice after the order has been processed, that is, after the goods have been delivered to the freight forwarder in charge of transportation.

3. COSTS AND METHODS OF TRANSPORT AND DELIVERY
3.1 The shipment of the purchased goods is entrusted to Transport Companies that provide national express courier service, with delivery within 24/48 hours after taking charge of the package. NO RESPONSIBILITY CAN BE IMPUTED ON FINESERVICE IN CASE OF LOSS, DAMAGE OR DELAY OF DELIVERY OF SHIPPED GOODS.
3.2 The electronic shopping cart system automatically calculates and adds the costs related to shipping charges to the order.
3.3 The sale of tangible goods via the Internet, being assimilated to mail order sales, is exempted from the obligation of tax certification (receipt and receipt), as well as the issuance of invoice, unless requested by the Customer. Upon explicit request by the Customer, Fineservice will issue a regular invoice of the purchased products, inserting the document inside the shipped packages or sending the document by e-mail to the order holder. For the issuance of the invoice, the information provided by the Customer at the time of the order shall be authentic. No change in the invoice will be possible, after the issuance of the same.
3.4 Unless explicitly stated by our Customer Service, delivery is intended to be at street level. At the time of delivery of the goods by the courier, the Customer is required to check:
- that the number of packages being delivered corresponds to what is indicated in the shipping slip delivered by the courier;
- that the packaging is intact, not damaged, nor wet or otherwise altered, including in the closing materials (adhesive tape, straps).
- Supplementary notes on delivery:
If the package delivered is damaged or altered (e.g. with the adhesive tape cut and / or replaced) we invite the Customer to accept the package by applying the note "Acceptance with Reserve" on the courier document. In the event that the courier's delivery document shows "Accepted without reserve", it will not be possible in any way to obtain the reimbursement provided by the insurance. We inform the Client that the insured shipment provides, in the manner and terms defined by the contracts with the shipper, the reimbursement of Euro 6.20 for each kilogram of merchandise weight.
3.5 Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 7 days after delivery, in the manner provided herein.
3.6 In case of failure to collect within 5 working days of the material in stock at the warehouses of the courier due to repeated inability to deliver to the address indicated by the Customer when placing the order, the order will be automatically canceled.

4. PRODUCT AVAILABILITY
4.1Detailedinformation sheets for each product are posted on the website www.teamsdeliverysrl.it. Each sheet also indicates the availability of the product at our warehouses and the expected delivery time. Due to the very nature of sales through e-commerce, it is possible that the indication on the availability of products may not be correct.
4.2Some of theproducts on sale carry the note "Right of Withdrawal: NOT APPLICABLE" in the information sheet. These are products that are not in stock and are supplied following a specific request from the Customer. ON THESE PRODUCTS IN NO CASE AND FOR NO REASON WILL BE APPLICABLE THE RIGHT OF WITHDRAWAL.

5. TRANSACTIONS AND SHIPMENTS RESPONSIBILITY
Fineservice disclaims any liability in the event of inefficiencies attributable to force majeure, events that would prevent the smooth execution of the contract, and is not responsible for loss of goods or damage incurred during transport. Fineservice is also not responsible for any illegal and fraudulent use of credit cards, checks and other means of payment,as at no time during the purchase process is able to recognize the buyer's credit card number, which, operating on a secure connection, sends the data directly to the Banking Institute that manages the service. Equally, it is not able to check the correct and lawful origin of the credit security that is delivered by the customer when collecting the goods.

6. WARRANTIES
6.1 All products sold by Fineservice are covered by the conventional manufacturer's warranty and the 24-month warranty for conformity defects, pursuant to DL 24/02. To take advantage of warranty assistance, the Customer must keep the order note inserted inside the packages shipped.
6.2 The manufacturer's conventional warranty is provided in the manner illustrated in the documentation inside the product packaging. Fineservice will return the component to the Supplier (or possibly to the designated Service Center) for verification of the reported defect. In the event that the right to replacement of the product under warranty is not recognized, Fineservice will report the reasons to the Customer, who will be charged any costs of verification and restoration required by the Authorized Assistance, as well as the costs of transportation, if incurred by Fineservice srl .
6.3 The 24-month warranty applies to the product that presents a lack of conformity, provided that the product itself is used correctly, in accordance with its intended use and as provided in the attached technical documentation. This guarantee is reserved for the Private Consumer (natural person who purchases the goods for purposes not related to his professional activity, that is, he makes the purchase without indicating in the order form a VAT number reference). In case of lack of conformity, Fineservice provides, without cost to the Customer, the restoration of conformity of the product by repair / replacement or reduction of the price, until the termination of the contract. If the right to replacement of the product under warranty is not recognized, Fineservice will inform the Customer of the reasons, who will be charged any costs of verification and restoration required by the Authorized Service, as well as transportation costs, if incurred by Fineservice srl .
6.4 Replacements in case of DOA (Dead On Arrival, or product not working on delivery) occur only if expressly provided for by the manufacturer. The timing of replacement or eventual repair of the product depends exclusively on the policies of the manufacturer.
6.5 In the event that, for any reason, it is unable to return to its customer a product under warranty (restored or replaced), Fineservice may proceed at its own discretion to refund the full amount paid or to replace it with a product of equal or superior characteristics.
6.6 No damages may be claimed from Fineservice for any delays in carrying out repairs or replacements.
6.7 In cases where the application of warranties provides for the return of the product, the goods must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc...). To limit damage to the original packaging, we recommend, when possible, to provide a suitable packaging.

7. RECLAMI E DIRITTO DI RECESSO (Normativa di riferimento: Codice del Consumo)
7.1 Eventuali reclami dovranno essere inoltrati all’indirizzo e-mail info@Fineservice .it, avendo cura di indicare i riferimenti dell’ordine.
7.2 DIRITTO DI RECESSO: se il Cliente è un consumatore (ossia una persona fisica che acquista la merce per scopi non riferibili alla propria attività professionale, ovvero non effettua l’acquisto indicando nel modulo d’ordine a Fineservice un riferimento di Partita IVA), ha diritto a recedere dal contratto di acquisto per qualsiasi motivo, senza necessità di fornire spiegazioni e senza alcuna penalità, fatto salvo quanto indicato al successivo punto 7.4
7.3 Per esercitare tale diritto, il Cliente dovrà inviare a Fineservice una comunicazione in tal senso, entro 10 giorni lavorativi dalla data di ricevimento della merce. Tale comunicazione dovrà essere inviata a mezzo lettera raccomandata con avviso di ricevimento, indirizzata a Fineservice –  via della Magliana 263 00146 Roma ovvero mediante telegramma o fax inviati sempre entro il suddetto termine di 10 giorni e seguiti da una conferma a mezzo lettera raccomandata con avviso di ricevimento, inviata TASSATIVAMENTE entro le 48 ore successive. Una volta pervenutaci la suddetta comunicazione di recesso, provvederemo a comunicare al cliente le istruzioni sulla modalità di restituzione della merce che dovrà pervenire a Fineservice entro 10 giorni dall’autorizzazione.
7.4 Il diritto di recesso è comunque sottoposto alle seguenti condizioni:
– il diritto si applica al prodotto acquistato nella sua interezza; non è possibile esercitare recesso solamente su parte del prodotto acquistato;
– il diritto NON si applica ai prodotti audiovisivi o a software informatici sigillati (compresi quelli allegati a materiale hardware), una volta aperti;
– il diritto NON si applica a prodotti confezionati su misura, prodotti costruiti su specifiche tecniche richieste dal Cliente, prodotti chiaramente personalizzati o che, per loro natura, non possono essere rinviati o rischiano di deteriorarsi o alterarsi rapidamente.
Il bene acquistato dovrà essere integro e restituito nella confezione originale, completa in tutte le sue parti (compresi imballo ed eventuale documentazione e dotazione accessoria: manuali, cavi, ecc…); per limitare danneggiamenti alla confezione originale, raccomandiamo di provvedere ad un adeguato imballaggio. Sul collo dovrà essere indicato, ben visibile, il numero di Rientro fornito da Fineservice A norma di legge, le spese di spedizione relative alla restituzione del bene sono a carico del Cliente. La spedizione, fino all’attestato di avvenuto ricevimento nel nostro magazzino, è sotto la completa responsabilità del Cliente. In caso di danneggiamento del bene durante il trasporto, Fineservice darà comunicazione al Cliente dell’accaduto (entro 5 giorni lavorativi dal ricevimento del bene nei propri magazzini), per consentirgli di sporgere tempestivamente denuncia nei confronti del corriere da lui scelto e ottenere il rimborso del valore del bene (se assicurato); in questa eventualità, il prodotto sarà messo a disposizione del Cliente per la sua restituzione, contemporaneamente annullando la richiesta di recesso. Fineservice non è in alcun modo responsabile per danneggiamenti o furto/smarrimento di beni restituiti con spedizioni non assicurate. Alla consegna nei propri magazzini, il prodotto sarà esaminato per valutare eventuali danni o manomissioni non derivanti dal trasporto. Qualora la confezione e/o l’imballo originale risultino rovinati, Fineservice provvederà a stornare dall’importo del rimborso le spese di ripristino.
7.5 Fatte salve eventuali spese di ripristino per danni accertati all’imballo originale, Fineservice provvederà a rimborsare al Cliente l’importo relativo ai prodotti restituiti ed alle spese di spedizione sostenute per l’invio di prima spedizione. Le uniche spese a carico del Cliente saranno quelle relative alla spedizione per la restituzione dei prodotti. Nessuna altra penalità sarà applicata. Il rimborso avverrà nel minor tempo possibile previsto per l’operazione e comunque entro 30 giorni dal ricevimento della comunicazione di recesso, tramite procedura di storno dell’importo addebitato sulla Carta di Credito o a mezzo Bonifico Bancario. In quest’ultimo caso, sarà cura del Cliente comunicare tempestivamente le coordinate bancarie (codice IBAN) relative al conto corrente su cui accreditare il rimborso.
7.6 Il diritto di recesso decade totalmente, per mancanza della condizione essenziale di integrità del bene (confezione e/o suo contenuto), nei casi in cui Fineservice accerti:
– la mancanza della confezione esterna e/o dell’imballo interno originale;
– l’assenza di elementi integranti del prodotto (accessori, cavi, manuali, parti, …);
– il danneggiamento del prodotto per cause diverse dal suo trasporto.
In caso di decadenza del diritto di recesso, Fineservice provvederà a restituire al mittente il bene acquistato, addebitando allo stesso le spese di spedizione.

8. OBLIGATIONS OF THE BUYER
The consumer agrees and undertakes, once the purchase procedure "online" is completed, to print and keep these general conditions, which, moreover, will have already viewed and accepted, as a mandatory step in the purchase, as well as the specifications of the product being purchased. It is strictly forbidden for the purchaser to enter false data, and / or invented, and / or fantasy, in the registration procedure necessary to activate against him the process for the execution of this contract and its further communications; personal data and e-mail must be exclusively his own real personal data and not of third persons and / or fantasy. It is expressly forbidden to make double registrations corresponding to one person or to enter data of third persons. Fineservice reserves the right to prosecute any violation and abuse, in the interest and for the protection of consumers.

9. AUTHORIZATIONS
By filling in the appropriate space, present on the website, the Customer authorizes Fineservice to use their credit card, or other card issued in its place, and to debit their bank account in favor of Fineservice the total amount highlighted as the cost of the purchase made "on-line". The procedure takes place through a secure connection directly connected to the Banking Institute, owner and operator of the payment service "on-line", which Fineservice cannot access. Should the consumer make use of the right of withdrawal (see point 8 of these general conditions), the amount to be refunded will be credited to the same credit card or in the manner chosen by the customer.

10. CONTRACT TERMINATION AND EXPRESS TERMINATION CLAUSE
Fineservice has the right to terminate the contract entered into by giving simple notice to the Customer. In this case, the Customer shall be entitled only to a refund of any amount already paid. The obligations assumed by the Customer referred to in Article 8 (Obligations of the purchaser), as well as the guarantee of the successful completion of the payment that the customer makes by the means referred to in Article 2 (sales prices and purchase methods), are essential in nature, so that by express agreement, the failure by the Customer to comply with only one of these obligations will result in the termination of the contract by right, without the need for judicial pronouncement, without prejudice to the right for Fineservice to take legal action for compensation for further damage.

11. PRIVACY
The personal data requested when placing the order are collected and processed in order to meet the expressed requirements of the Customer and will not under any circumstances and for any reason be transferred to third parties, nor will they be used to send advertising material without the prior consent of the owner. Fineservice guarantees its customers the respect of the legislation on the processing of personal data, governed by the privacy code referred to in DL 196 of 30.06.03. Owner of the data processing is Fineservice

12. APPLICABLE LAW
The sales contract between the Customer and Fineservice is concluded in Italy and governed by Italian Law. For the solution of civil and criminal disputes arising from the conclusion of this distance sales contract, if the Customer is a consumer, the territorial jurisdiction is that of the reference court of his town of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Rome.
